Reinstate MC Authority: How FMCSA Reinstatement Works
How to reinstate MC authority after a revocation: why it happens, how to check your status, Form MCSA-5889, the $80 fee and the filings needed first.
Questions about how this applies to you? Talk to a licensed agent who ran his own authority.
Getting a letter that your MC authority was revoked is scary. It means you cannot haul for hire across state lines under that authority until it is fixed. The good news: FMCSA has a process to reinstate MC authority. Here is why authorities get revoked, how to check your status and how the reinstatement request works.
Why operating authority gets revoked
Operating authority is your federal permission to haul for hire across state lines. It is tied to your MC, FF or MX number. FMCSA can revoke it for reasons like these:
- Your insurance filing was cancelled. If the insurance company cancels your policy, it notifies FMCSA. Without a valid filing, your authority can be revoked.
- Your BOC-3 is missing. The BOC-3 is the form that names your process agents, the people who can receive legal papers for you in each state. Our BOC-3 guide explains it.
- Other compliance problems, such as unpaid penalties or a request you made yourself to stop.
Read the letter from FMCSA carefully. It tells you the reason. Fix the reason first, or the reinstatement will not go through.
How to check your authority status
Look up your USDOT or MC number on FMCSA's SAFER website. The Company Snapshot shows your operating authority status. The FMCSA Licensing and Insurance system also shows your insurance and BOC-3 filings on record.
If the status says your authority is not authorized, find out why before you do anything else.
How to reinstate MC authority, step by step
Here is how FMCSA describes the process:
- Get your filings back on record. FMCSA will not reinstate your authority until your BOC-3 and the required insurance are on file. Your process agent company files the BOC-3. Your insurer files proof of insurance with FMCSA. You cannot file the insurance proof yourself.
- Request reinstatement. You can ask online through your FMCSA Portal account, or send the signed Form MCSA-5889 (the Motor Carrier Records Change Form) through FMCSA's ASK website.
- Pay the fee. FMCSA charges $80 to request a reinstatement. The fee is not refundable.
- Wait for processing. FMCSA says authority is typically active within about a week after it receives the application and a valid payment. Paper requests can take longer.
- Check SAFER again. Confirm your status shows active before you haul.
Do not haul interstate for hire until your authority shows active again.
While you wait, keep copies of everything: the FMCSA letter, your payment receipt, your signed form and proof that your BOC-3 and insurance filings are on record. If a broker asks why your status changed, you can show that the problem was fixed. It also helps if FMCSA asks you for more information. Write down the dates you sent each item, too.
Mistakes to avoid
- Paying the fee before your filings are in place. FMCSA will not reinstate without them.
- Trusting websites that promise a faster result for a big fee. The FMCSA fee is $80. Use official FMCSA channels.
- Letting your insurance lapse again. Watch your payment dates and renewal notices.
- Ignoring FMCSA mail and email. Keep your contact details current so warnings reach you.
How to avoid a revocation next time
- Set reminders for insurance payments and renewals.
- Make sure any change of insurance company includes a new filing with FMCSA before the old one ends.
- Keep your BOC-3 active with your process agent company.
- Check your SAFER snapshot every few months.
Our filing guide lists the filings a carrier with its own authority needs to keep up.
