A DataQs challenge is how you ask for a review when a violation or crash on your safety record looks wrong. Mistakes happen. An inspection report can list the wrong carrier, the wrong driver or a violation that was not there. That data can stay on your public record and follow you. This article explains what DataQs is, who decides, and how to file a strong request.

What DataQs is

DataQs is an online system run by FMCSA, the Federal Motor Carrier Safety Administration. It is the official way to file concerns about federal and state safety data that FMCSA releases to the public. Your request is sent automatically to the right office, and you can follow its status online.

A request is called a Request for Data Review, or RDR.

Who can file a DataQs challenge

Anyone can file a request: drivers, motor carriers, service providers and members of the public. According to state guidance on DataQs:

  • Motor carriers log in through their FMCSA Portal account.
  • Drivers and other users create a DataQs account directly.

DataQs now requires multifactor authentication. Many users sign in with Login.gov, using the same email as their DataQs account.

What you can challenge

You can ask for a review of data from roadside inspection reports and crash reports.

  • For inspections: vehicle, driver and carrier information, hazmat information, the violations, and adjudicated citation data. Adjudicated means a court has already decided the ticket.
  • For crashes: vehicle, driver and carrier information, hazmat information, and whether the crash was reportable.

Who decides

This is important. When the data came from a state agency, that state agency reviews your request. Once the state decides, FMCSA treats that decision as the final resolution. FMCSA cannot change a state's records without the state's consent.

Also, a DataQs request does not affect a local ticket. If you got a citation with a fine or a court date, you still have to deal with that through the agency or court that issued it.

How to file a DataQs challenge, step by step

  1. Get the inspection or crash report. Find the report number, date and state.
  2. Pick the exact item that is wrong. One clear problem per request works best.
  3. Gather proof. Examples: repair receipts with dates, photos with time stamps, ELD records, the court's dismissal or ruling, a lease agreement that shows who the carrier was.
  4. Log in to DataQs at dataqs.fmcsa.dot.gov and start a Request for Data Review.
  5. Write a short, clear explanation. Say what is wrong, what it should say and what your proof shows. Stay polite and stick to facts.
  6. Upload your documents and submit.
  7. Watch the status in DataQs and answer any questions from the reviewer quickly.

Mistakes to avoid

  • Filing without proof. The reviewer needs evidence, not just your word.
  • Arguing about the officer instead of the facts.
  • Thinking DataQs cancels a ticket. It does not.
  • Waiting too long. Keep your records while they are fresh.

Common questions

Can I remove a violation from my record with DataQs? You can ask for a review. If the reviewing agency agrees the data is wrong, it can be corrected. The decision belongs to the agency that reported the data.

Who reviews a DataQs request? For data from a state, the state agency reviews it. FMCSA treats the state's decision as final.

Does DataQs fix my ticket? No. A Request for Data Review does not affect a local citation. Contact the agency or court that issued it.
